American border guards have the right to interview and inspect arriving women as part of the fight against illegal tourism schemes for the birth of children in the United States for the sake of citizenship, and the decision on admission to the country will be made individually, the Border and Customs Service of the United States reported.

“An officer of the Border and Customs Service has the right to interview travelers, conduct inspections and make decisions on admission to the country in accordance with US law,” a representative of the agency said when asked whether a pregnant woman who arrived on a tourist visa could not be allowed to enter the States.

The adoption of this decision will be based, among other things, on data related to national security, the structure informed.

“The decision on admission is made on an individual basis, taking into account information from law enforcement agencies, data related to national security, and immigration information available at the time of the inspection,” the department said.

The department recalled the position of the leadership of the Department of Homeland Security that the practice of obtaining tourist visas for subsequent arrival in the United States in order to have a child does not correspond to the original purpose for which the amendment to the Constitution of the States on citizenship by birth was adopted.

On June 30, the US Supreme Court blocked the initiative of American President Donald Trump to abolish the universal right to citizenship for children born in the country. After that, the United States Department of Justice warned that arriving in the United States on a tourist visa for the sole purpose of giving birth to a child violates federal law. The authorities have promised to prosecute the organizers of such schemes.
